GTC

General Terms and Conditions

These General Terms and Conditions («GTC») govern the legal relationship between Frutt Taxi («Service Provider») and its customers for all contracts and other services provided by the Service Provider to the customer. The GTC apply in the version valid at the time of the customer’s order. The customer accepts these GTC by registering for telephone, written, fax, and email bookings. Provisions or general terms and conditions of the customer that contradict these GTC will not be recognized, even if the Service Provider does not expressly object to them.

Conclusion of Contract
By submitting their registration or booking via post, fax, or email, or by registering or booking via telephone, the customer makes a legally binding offer to conclude a contract. The contract is concluded when the Service Provider accepts this offer through an order confirmation or booking. The Service Provider may reject offers without providing a reason. Cancellations made less than 48 hours before the agreed date must still be paid in full; cancellations made less than 14 days before the agreed date must still be paid at 50%. This applies to all bookings.

The current prices can be viewed at www.fahrdienst-haslital.ch. All prices are stated in Swiss Francs (CHF). Printing errors and price changes are reserved. The price valid at the time of registration or booking is decisive. Special offers are only valid for the stated period. Reduced prices are only valid within the payment period of 30 days or in the case of advance payment. If the payment deadline is exceeded, the regular price becomes due. In the event of default, the Service Provider is entitled to cancel subsequent registrations and bookings of the buyer and charge any reminder and/or collection costs as well as any default interest to the customer. From the second reminder stage onward, we charge CHF 20.00 per reminder for the extended damage caused by the delay (pursuant to OR 106). Furthermore, default interest of 5% is due from the invoice due date.

The Service Provider reserves the right to carry out bookings for new customers and larger bookings from existing customers only against advance payment. For bookings from foreign customers, an advance payment appropriate to the service will be requested. We ask for your understanding regarding this measure. This amount will, of course, be offset in the final invoice (credit or refund). The Service Provider may, at its discretion, waive this regulation in exceptional cases. Offsetting is only possible with claims acknowledged in writing.

Liability
Unforeseen obstacles, such as force majeure, strikes, accidents, weather, etc., which cause delays in the service, release the Service Provider from complying with agreed bookings. Likewise, the Service Provider is not liable for third parties (hotels and SAC huts whose cause lies outside the business operations of the Service Provider).

The Service Provider has business liability insurance. Any claims for damages to customers or third parties will be conclusively reviewed and settled by this insurance. Further claims for liability, regardless of the legal basis, are excluded. When participating in trips and other services, insurance (accident and liability insurance) is the responsibility of the participant. Participation in services offered by the Service Provider is at the participant’s own risk. The Service Provider declines any liability in the event of accidents.

Data Protection
The data necessary for processing business transactions will be stored. All personal data will, of course, be treated confidentially. Exceptions are statutory reporting obligations.

Jurisdiction
The place of performance for all services and payments, as well as the jurisdiction for all disputes, is the registered office.

Amendments and Validity of the GTC
The Service Provider reserves the right to amend the content and scope of these GTC at any time. They will be brought to the buyer’s attention through publication on www.frutt-taxi.ch. If any provision of these GTC or any other contractual agreement becomes invalid or unenforceable, the validity of the remaining provisions of the GTC and the contract as a whole shall remain unaffected.
